A man who was sentenced in 2016 to ten years in jail for the 2011 manslaughter death of 54-year-old Robert Topping is being retried later this month.
Shaldon Wabason elected to be tried in the Superior Court of Justice by a judge alone.
The prosecution tells us this decision will have a significant impact on the time that the proceedings take.
The matter will be back in court March 21st to be spoken to.
Wabason won the appeal of his case last March.
Wabason was charged with manslaughter and breaking and entering.
