The City is now facing only one class action lawsuit in relation to the 2012 flood as the claimants have agreed to move some of their allegations into the first class action suit.
City Manager Tim Commisso says one of the claims is that residents allege the City contributed to the overloading of the Atlantic Avenue Plant by not enforcing its downspout disconnection by-law.
Commisso says they dispute that and notes they tried for several years to get homeowners to get rid of the spouts that run directly into the sewer.
Commisso adds it’s the home owners responsibility to comply.
Although the City doesn’t accept the allegation as a precaution, Thunder Bay is sending out third party notice to 200 property owners about their failure to disconnect rain water leaders and downspouts.
